Prosecutors will not file upgraded charges against a Nocatee man whose wife died after he crashed his golf cart, his attorney confirmed to The Citizen Wednesday.

Angelo Theodosiou, 64, had faced the possibility of felony charges following the tragic accident that killed his wife, Christina Theodosiou, 58, in December.

Authorities had considered whether the incident warranted more serious charges because of the fatality, but prosecutors will now resolve the case on the existing misdemeanor counts.

L. Lee Lockett, the Jacksonville-based lawyer representing Theodosiou, confirmed the decision.

“They agreed not to file it in felony court and we intend on resolving his case on the misdemeanor charge,” Lockett said.

Angelo and Christina, originally from New York, had moved to Nocatee in recent years to retire. Before relocating, Angelo ran a successful restaurant in Queens.

Christina was a passenger in the golf cart her husband was driving. She fell from the vehicle after the accident and struck her head on the concrete.

She was airlifted to Memorial Hospital Jacksonville and passed the following day.

The St. Johns County Sheriff’s Office previously alleged that Theodosiou may have been under the influence, charging him with misdemeanor DUI and refusal to submit to a breath test.

Friends described the situation as heartbreaking. “They are both wonderful, wonderful people,” a family friend told The Citizen at the time. “They retired here and were really happy. It’s just terrible, it’s unbelievable.”

Theodosiou’s case will now move forward on the misdemeanor level, and that case is pending.
